In the heart of St. Louis, a man known for his warmth and dedication to his work at a local convenience store became a victim of senseless violence. Mack A. Wagner, a 62-year-old Black male, was a familiar and beloved face at Kaiser's Grand Mart in the Dutchtown neighborhood. His life was tragically cut short on the afternoon of July 29, 2024, during a confrontation that began over a simple act of theft.
On that fateful day, Wagner, a long-time employee, observed a customer attempting to steal items from the store. When he confronted the individual, an argument quickly escalated. In an attempt to de-escalate the situation and protect the store's property, Wagner used pepper spray on the man. The response was not one of retreat, but of deadly aggression. The man drew a firearm and shot Wagner in the lower abdomen before fleeing the scene with a female companion. Emergency services arrived to find Wagner unconscious and barely breathing. He was rushed to a local hospital, where he succumbed to his injuries a short time later.
The St. Louis Metropolitan Police Department launched an investigation into the homicide, and a suspect was identified as 45-year-old John D. Phillips. For several months, Phillips remained at large. However, on November 22, 2024, the St. Louis Circuit Attorney's Office issued warrants for his arrest, charging him with first-degree murder, armed criminal action, first-degree robbery, and unlawful possession of a firearm. He was taken into custody the following Monday.
In a resolution to the case, John D. Phillips appeared in court on July 25, 2025. As part of a plea agreement, he pleaded guilty to a lesser charge of second-degree murder. The charges of robbery, armed criminal action, and unlawful gun possession were dismissed. A St. Louis Circuit Judge accepted the plea deal and sentenced Phillips to 25 years in prison for the murder of Mack Wagner, bringing a close to the legal proceedings in a case that began with a petty crime and ended in a heartbreaking loss for the community.
