Shamy rushed out of the bathroom to find her sister, Nakeitha, falling to the floor with blood running from her head, mouth, nose, and ears. Nakeitha had been shot in the head, directly between her eyebrows. Brandon Deshun Pearson, who was present at the scene, claimed that Nakeitha had shot herself and that the shooting was an accident. Shamy ran to a neighbor's apartment to call 911. When Dallas Police Officer Matthew Banes arrived at the scene, he found blood and footprints tracked through the living room, with two females and a male present.
Brandon Deshun Pearson was subsequently arrested and charged with the murder of Nakeitha Gibson. He was convicted of her murder and appealed the conviction, claiming that the evidence was factually insufficient and that the trial court erred in denying his motion to suppress. However, the Texas Court of Appeals, Fifth District, affirmed the trial court's judgment, upholding Pearson's conviction.
