His death was the result of a brutal murder committed by John Patrick Gutierrez, who was 39 years old at the time. Gutierrez was indicted on a murder charge in September 2015, and it was revealed that he assaulted Carey Rod Tate with a wrench, choked him, and broke his neck in front of a witness.
