On May 10, 2016, a domestic dispute in a Cumberland Furnace, Tennessee, home ended in the shooting death of 35-year-old Daria Paulina Luck. A 911 call was made by her husband, Benjamin Luck, 33, who admitted to shooting his wife. When deputies from the Montgomery County Sheriff's Office arrived at their Houston Road residence, they found Daria Luck deceased inside the home.
The couple's three young children were also present in the house at the time of the incident but were not physically harmed.
According to Benjamin Luck's account to investigators, the shooting occurred after a domestic argument during which his wife allegedly threatened to kill him. He stated that she armed herself with a knife, prompting him to get a gun. He claimed to have shot her multiple times in fear for his life. However, the investigation revealed that he continued to fire at her as she was retreating and even shot her again after she had collapsed on the couch. He reportedly told investigators he was unsure if she still had the knife when he continued to shoot.
Benjamin Luck was taken into custody at the scene and subsequently charged with criminal homicide. Initially facing a charge of first-degree murder, he later pleaded no contest to the lesser charge of voluntary manslaughter. This plea acknowledged that there was sufficient evidence for a potential conviction without admitting guilt. In June 2017, he was sentenced to four years in prison, receiving credit for the 391 days he had already served. The case drew attention to the complexities of domestic violence and the legal arguments surrounding claims of self-defense.
