Devon Brown, a 29-year-old Black male, was killed on May 31, 2017, outside his home at the Marion Terrace Apartments on Mark Drive in Hanover Township, near Wilkes-Barre, Pennsylvania. What began as a celebration for children became a fatal confrontation after Brown's son and the son of Tremaine Divine Jamison, both kindergarten graduates, were involved in a dispute during or after the day's festivities. The celebration had included a graduation ceremony and a trip involving the children, but by evening the tension between adults had followed everyone back to the apartment complex.
According to accounts presented in court, the conflict escalated after Jamison and others returned to the area. Witnesses described a fight in the yard, with prosecutors portraying Jamison as the aggressor. Brown's girlfriend and neighbors said Jamison struck Brown first and pulled a knife, after which Brown went inside and returned with a kitchen knife. Witnesses later testified that Brown was trying to get away when Jamison obtained a handgun and fired a single shot from a distance, striking Brown in the head. Brown died in the street outside his home as people who had gathered for what was supposed to be a children's celebration watched the scene turn into a homicide.
Investigators identified Tremaine Divine Jamison, then 27 and from New York City, as the suspected shooter. Authorities said he fled after the shooting and was not taken into custody in Pennsylvania right away. He was eventually found and arrested in Savannah, Georgia, in 2019, about two years after Brown's death. He was later brought back to Luzerne County to face prosecution. Prosecutors charged him with an open count of criminal homicide, and he also faced a firearm charge because authorities alleged he was prohibited from possessing a gun.
Another man, Basim Labeem Murdaugh, was tied to the case through the weapon. Investigators alleged that Murdaugh provided Jamison with the. 40-caliber handgun used in the fatal shooting. Murdaugh faced separate gun-related charges and later pleaded guilty to illegal possession of a firearm. He was sentenced to two to four years in state prison.
Jamison's homicide trial began in May 2021. Prosecutors told jurors that Brown was shot while running away and argued that Jamison knew what he was doing when he fired. The defense argued self-defense, claiming Brown had been armed with a knife and that Jamison fired because he believed he was in danger. During the trial, several witnesses testified for the Commonwealth, including eyewitnesses who said Jamison struck Brown first, pulled a knife when Brown was unarmed, then went to retrieve a gun and shot Brown from a distance.
Midway through the trial, after prosecutors rested their case, Jamison accepted a plea agreement and pleaded guilty to third-degree murder. Even as he entered the plea, he continued to suggest he had acted in self-defense and later sought to withdraw the plea, claiming it was not voluntary and that he was innocent. The court rejected that request, finding that he had entered the plea knowingly and voluntarily and that the evidence presented at trial did not support a plausible self-defense claim.
On September 23, 2021, Jamison was sentenced to 18 to 40 years in state prison for third-degree murder. He appealed, but the Pennsylvania Superior Court affirmed the judgment in October 2022, leaving the sentence in place. The case ended with Jamison convicted for Brown's killing and Murdaugh separately punished for his role involving the firearm, after a dispute rooted in a children's graduation celebration left Brown dead outside his home.
