In the late hours of an April evening in 2014, a verbal altercation erupted between acquaintances at the Bradford Gwinnett Apartments in an unincorporated area of Norcross, Georgia. The dispute quickly escalated into a physical confrontation, and tragically, gunshots rang out. Caught in the crossfire was Kevin Pierre, a 23-year-old male resident of the complex. He was an innocent bystander, uninvolved in the conflict, who was struck by a stray bullet. After being shot, he fled the immediate scene on foot before collapsing in a nearby wooded area where his body was discovered by an officer shortly after midnight.
In the wake of the shooting, Gwinnett County police identified two suspects, charging both Sherwin Johnson and Quinton Hall with felony murder and aggravated assault. Johnson, who was 34 at the time, was apprehended by authorities within a couple of weeks of the incident. The second suspect, 29-year-old Quinton Hall, remained at large, and police sought help from the public to locate him. The investigation suggested that Pierre was not the intended target but was an unfortunate victim of a dispute that turned violent.
The legal proceedings that followed took a number of turns. Sherwin Johnson opted to represent himself in court, a rare move in a murder trial. In December 2018, the jury was unable to reach a unanimous verdict on several of the charges, including the felony murder count, resulting in a mistrial for those specific charges. However, the jury did convict Johnson on two counts of aggravated assault and two drug charges. It was not immediately clear if he would face a new trial for the deadlocked charges. Johnson had also previously argued his case before the Georgia Supreme Court, asserting that there was a lack of substantial evidence for his arrest and that his right to a speedy trial had been violated, though his efforts to have the charges dismissed were unsuccessful. In addition to the criminal case, the family of Kevin Pierre filed a civil lawsuit against the apartment complex, alleging that the management was aware of significant criminal activity on the property but failed to adequately warn or protect its residents.
