In September 2018, the life of 26-year-old Carly Dorian Andrews was cut short in a Gainesville, Georgia apartment she shared with her boyfriend. On September 6, authorities were called to the Glenn Cove Apartments on Norton Drive with a report of a self-inflicted or accidental shooting. Inside, they found Carly Andrews deceased from a gunshot wound to the chest.
Initially, her 21-year-old boyfriend, Christopher Vargas Zayas, suggested that the shooting was either accidental or self-inflicted. However, as Gainesville police delved deeper into the circumstances surrounding her death, their investigation uncovered evidence that pointed away from an accident. The findings were substantial enough for investigators to arrest Zayas and charge him with murder. Following his arrest, he was held in the Hall County Jail without bond.
The investigation into Carly's death also led to further charges against Zayas. Authorities added possession of marijuana with intent to distribute and possession of a firearm during the commission of a felony to the accusations against him. Zayas was later indicted on multiple charges, including malice murder, felony murder, aggravated assault with family violence, possession of marijuana with intent to distribute, and three counts of possession of a firearm during the commission of a felony.
Christopher Vargas Zayas was subsequently found guilty on all counts and received a sentence of life in prison with the possibility of parole. In an attempt to overturn the verdict, he appealed his conviction, arguing that the evidence was circumstantial and did not rule out the possibility that the gun discharged accidentally when Andrews grabbed it. His appeal also claimed his lawyer was ineffective for not suppressing statements he made before being read his Miranda rights. In May 2024, the Supreme Court of Georgia upheld the murder conviction, concluding the jury was justified in rejecting his version of events and that his legal counsel had not been deficient.
