During the ensuing struggle, a shot was fired into the floorboard of Gilbert's vehicle, prompting Simmons to flee the scene and retrieve a firearm from his apartment.
Upon returning, Simmons fired multiple rounds into Gilbert's SUV as it attempted to leave the parking lot. Gilbert was struck at least three times, with one bullet piercing his back and lodging under his sternum. The vehicle crashed, and Gilbert succumbed to his injuries.
