Marco Anthony Delgado Jr., a 13-year-old boy from Long Beach, California, tragically lost his life on October 7, 1995. The incident occurred after he and two friends were admitted to watch the R-rated movie "Dead Presidents" at a local theater without adult supervision. The film, known for its graphic depictions of violence, agitated one of the boys, Raymond Aiolentuna, who later expressed violent intentions. After the movie, Aiolentuna shot and killed Marco Delgado Jr. on a nearby street corner.
Following the incident, Marco's parents, Beatriz and Marcos Delgado, filed a lawsuit against American Multi-Cinema, Inc. (AMC), the theater's operator. They alleged negligence on the part of AMC for allowing minors to watch an R-rated movie unaccompanied by an adult, which they argued contributed to their son's death. The court initially allowed the case to proceed but ultimately dismissed it after sustaining AMC's demurrer without leave to amend, concluding that the plaintiffs failed to state a cause of action.
The case highlighted the responsibilities of movie theaters in enforcing age restrictions for R-rated films and the potential consequences of failing to do so. Despite the tragic outcome, the legal proceedings did not result in any criminal charges against AMC or its employees. The focus remained on the civil litigation, which ended in favor of the theater chain.
