Jerome Mallory, an 18-year-old resident of San Francisco, was tragically killed on the night of July 5, 2020. The incident occurred in the Bayview District, where Mallory was walking down the street around 11 p.m. when a white Honda Accord with four men inside approached him. Nearly 20 bullets were fired from the vehicle, striking Mallory and a nearby car. Despite being rushed to the hospital, Mallory succumbed to his injuries.
This shooting was part of a violent Fourth of July weekend in the Bayview, which also saw the death of a 6-year-old boy in a separate incident.
The investigation into Mallory's death revealed that it was linked to an ongoing gang rivalry between two San Francisco gangs, Tre-4 and Double Rock. Police and prosecutors believed that Mallory's killing was a retaliatory act in this violent feud. Two men, Sincere Pomar and Stevie Mitchell, were later charged with Mallory's murder. The case, however, became complicated due to a potential conflict of interest involving San Francisco District Attorney Brooke Jenkins, who is related to Mallory through her husband. Jenkins recused herself from the case to avoid any appearance of bias.
As the case progressed, defense attorneys argued that the charges were influenced by Jenkins' public statements and her campaign to recall former District Attorney Chesa Boudin. They contended that the gang conspiracy charges were necessary to build a strong case, but without them, the evidence was insufficient for a murder conviction. Ultimately, the California Attorney General's Office took over the case and decided to drop the murder charges against Pomar and Mitchell. Instead, Pomar pleaded guilty to accessory after the fact, and Mitchell pleaded guilty to assault with a firearm, resulting in prison sentences of six and seven years, respectively.
The case highlighted the complexities of prosecuting gang-related crimes and the challenges of maintaining impartiality in high-profile cases involving public officials. Despite the resolution, questions remained about the adequacy of the evidence and the influence of political dynamics on the judicial process.
