Elya Jerry Aguilar, an 18-year-old from Merced, California, tragically lost his life on October 8, 2022, in a violent incident that shocked the local community. The fatal event occurred in the early hours of the morning at a parking structure near M and 19th Street, close to Merced City Hall. Merced police responded to reports of shots fired at approximately 3:12 a.m.
Upon arrival, they encountered a chaotic scene with numerous individuals fleeing on foot and in vehicles, some of whom were armed. Aguilar was found at the scene with fatal gunshot wounds, and despite immediate medical attention, he was pronounced dead.
The investigation revealed that the incident was gang-related and involved multiple suspects. A fight had broken out, leading to a 16-year-old suspect opening fire on a vehicle occupied by several individuals. This initial act of violence triggered an exchange of gunfire, resulting in Aguilar's death and injuries to three other individuals. The wounded were transported to regional trauma centers for treatment. The 16-year-old shooter, who was also injured in the exchange, was arrested on suspicion of murder, shooting at an occupied vehicle, and gang-related charges. Another 16-year-old was apprehended for attempting to flee the scene with the firearm believed to be the murder weapon, and he faced similar charges.
Further investigation led to the arrest of two additional suspects. A 17-year-old suspect voluntarily went to the police station to discuss his involvement in the incident, leading to his arrest after detectives found another firearm at his residence. Additionally, 25-year-old Marcos Montoya was arrested for negligent discharge of a firearm, carrying a concealed firearm in a public place, and possession of an unregistered firearm. Montoya had accidentally shot himself during the incident but survived his injuries.
The Merced Police Department's investigation into Aguilar's death was thorough, involving multiple arrests and the collection of significant evidence.
