On a summer night in Queens, New York, a gathering of friends turned tragic, leading to the untimely death of 24-year-old Rufino Perez Villa on June 12, 2016. The group had been drinking and engaging in playful fighting in a basement apartment on National Street in the Corona neighborhood. During this, Christian Penaloza, 29, introduced a shotgun into their activities.
What was intended as a display of the firearm took a fatal turn.
As Penaloza was showing the shotgun to Perez Villa, the weapon discharged, striking Perez Villa in the chest. Despite being rushed to Elmhurst Hospital, he succumbed to his injuries the following day. The police investigation that followed determined the shooting to be accidental.
Christian Penaloza was subsequently arrested in connection with the death. Investigators concluded that there was no evidence to suggest Penaloza intended to kill his friend. As a result, he was charged with criminally negligent homicide rather than murder. Penaloza was known to have a history of prior arrests for offenses including drugs, burglary, assault, criminal mischief, and robbery. He was also identified as a member of a gang. Another man present at the scene, John Zhumi, was also taken into custody on unrelated outstanding warrants.
