In the late hours of a Sunday evening in Manhattan's East Village, a young man's life was abruptly ended by a single act of violence. On May 15, 2022, Brandon Atkinson was fatally shot in the head near the corner of Avenue D and East Third Street. First responders arrived at the scene around 11:15 p.m., following a 911 call and an activation of the ShotSpotter system, to find Atkinson unconscious and unresponsive.
He was rushed to Bellevue Hospital, where he was pronounced dead.
The investigation into the death of the 21-year-old Bronx resident pointed to a tragic case of mistaken retribution amidst a feud between rival gangs. Authorities determined that Atkinson, though an associate of the 'Down the Hill' gang, was not involved in a robbery that had targeted a member of the rival 'Up the Hill' gang. Seeking revenge for this robbery, a member of the 'Up the Hill' crew traveled to what was considered rival territory. While Atkinson was at a deli, he was shot in the back of the head.
In the months that followed, law enforcement officials made a significant breakthrough in the case. On August 9, 2022, police arrested 18-year-old Zymir Humphrey in connection with the murder. Humphrey was apprehended by U.S. Marshals in West Virginia in July 2022 and extradited back to New York. He was subsequently charged with murder and criminal possession of a weapon.
The legal proceedings culminated in a guilty plea from Humphrey. On November 4, 2024, he pleaded guilty to one count of Murder in the Second Degree. Following his plea, Zymir Humphrey, then 20, was sentenced to 15 years-to-life in state prison for the killing of Brandon Atkinson. The sentencing brought a measure of closure to a case that highlighted the devastating and often misdirected consequences of gang violence in the city.
