On October 28, 2005, a 20-year-old Black male named Devin McCain was found deceased in front of a two-family home in Jackson, Michigan. An investigation revealed that he had sustained a fatal gunshot wound to the head. The events that led to his death began with a dispute between McCain and a member of a local gang. Despite McCain not having any gang affiliation himself, the conflict escalated, and threats were made against him.
Approximately one month after the initial altercation, the
gang member, accompanied by two other individuals, confronted McCain at an apartment. Witnesses reported that all three of the men who arrived to confront McCain were armed. As McCain was exiting the apartment, he was shot. The investigation into the shooting led authorities to a man named James Whetstone.
James Whetstone was arrested and subsequently charged in connection with Devin McCain's death. He faced charges of first-degree murder and conspiracy to commit first-degree murder. Following a trial, a jury acquitted Whetstone of the first-degree murder charge. However, he was found guilty of conspiracy to commit first-degree murder. The conviction was reportedly based on testimonies that Whetstone had confessed to the shooting. Further testimony indicated that during an armed robbery that occurred two weeks after the shooting, Whetstone had made references to the murder.
Following his conviction, James Whetstone was sentenced to life in prison. He later appealed his conviction, but the Michigan Court of Appeals upheld the original verdict. The legal proceedings highlighted the difficulties investigators faced in obtaining reliable witness testimony. Devin McCain was laid to rest at Woodland Cemetery in Jackson, Michigan.
