In the late hours of a Wednesday night in September 2016, a chain of events began that would ultimately lead to the tragic death of Richard M. Flynn, a 42-year-old Caucasian male. Flynn had been out for drinks with Trina Kusters, the wife of Mark Kusters, and a neighbor. When Trina returned to the Grand Rapids home she shared with her husband, they reportedly saw Flynn looking into their windows.
This encounter would prove to be fatal for Flynn.
An enraged Mark Kusters, who had discovered an affair between his wife and Flynn less than a month prior, grabbed his Mossberg shotgun and went outside to confront him. The ensuing altercation in the yard of the Kusters' property, located in Wisconsin Rapids, Wisconsin, ended with Kusters shooting Flynn. Flynn sustained gunshot wounds to his chest and abdomen and was airlifted to a hospital in Marshfield, where he was pronounced dead less than two hours later, in the early morning of September 15, 2016.
Mark Kusters, then 58 years old, was arrested and charged in connection with the shooting. The investigation revealed a history of animosity from Kusters towards Flynn following the discovery of the affair. Evidence presented during the legal proceedings included threats Kusters had made to Flynn, and an entry in his phone labeling Flynn as "DEADBOY". After his arrest, Kusters was recorded in a police vehicle saying, "Yeah, I f---cking shot his ass".
In November 2017, a jury found Mark Kusters guilty of first-degree reckless homicide. While the defense argued that the shooting was accidental, alleging that Trina Kusters had pulled on her husband's collar causing the gun to discharge, the prosecution pointed to the prior threats as evidence of intent. Ultimately, the jury convicted him on the reckless homicide charge, a class B felony carrying a potential sentence of up to 60 years in prison. Kusters was initially held on a $1 million cash bond following the incident.
