On October 16, 1995, the life of 36-year-old White/Caucasian male John Bananola, an eight-year veteran of the Pierce County Sheriff's Department, was tragically cut short. Bananola was part of a six-man team serving a narcotics-related search warrant at a residence located at 902 E 52nd Street in Tacoma, Washington. As the first deputy to enter the home, he was immediately confronted by a suspect inside.
Despite identifying himself as a law enforcement officer, the suspect, Brian
Eggleston, opened fire with a 9mm handgun. In the ensuing chaos, Eggleston fired at least ten rounds, striking Deputy Bananola nine times in the head and torso. Though mortally wounded, Bananola was able to return fire, hitting Eggleston in the groin. Less than an hour after the raid began, John Bananola was pronounced dead at a local hospital.
The legal aftermath of the shooting was a long and convoluted process that spanned years. Brian Eggleston was arrested and faced a series of trials. In his first trial in 1997, the jury could not reach a unanimous decision on the charge of first-degree murder, resulting in a hung jury, though they did convict him on assault and four drug charges. A second trial in 1998 resulted in a conviction for second-degree murder, and he was sentenced to 40 years in prison.
However, this was not the end of the legal battle. The murder and assault convictions were later overturned by an appeals court due to issues with jury instructions, illegally seized evidence, and juror misconduct. This led to a third trial, where Eggleston was again convicted of second-degree murder. Over the years, his sentence was subject to multiple appeals and adjustments. Initially sentenced to a longer term, subsequent appeals court rulings led to resentencing. Ultimately, Brian Eggleston was sentenced to a lengthy prison term for the death of Deputy Bananola.
