On February 23, 2017, 36-year-old Jason Stubby, a White male, was found dead in a residence in Newton, Kansas, the victim of a triple homicide. Two other men, Michael Lemons and Nelton Dean Lemons, also lost their lives in the violent encounter.
Early that morning, a distressing 911 call was made from the home. A woman's voice, strained with emotion, informed the dispatcher that people had been shot.
Her cries were abruptly interrupted by a man's voice, "Sorry, I didn't mean to call you." This cryptic message was the last communication from the house before law enforcement arrived.
Police officers were dispatched to the residence where they discovered the three deceased victims. Acting on information from witnesses at the scene, officers were able to quickly identify a suspect, David Montano, who was located nearby.
When confronted by law enforcement, Montano was armed with a shotgun. He refused repeated commands to drop his weapon and instead, pointed it at the officers. In the ensuing standoff, an officer fired, fatally wounding Montano. The Harvey County Attorney later determined that the officer's use of deadly force was justified. While the motive for the killings was not definitively stated, authorities suggested that the incident was likely related to a domestic situation rather than being drug-related, though Montano did have a criminal history involving drug distribution. No other suspects were identified or arrested in connection with the deaths of Jason Stubby, Michael Lemons, and Nelton Dean Lemons.
