On October 14, 2014, in the small town of Hyrum, Utah, a domestic conflict culminated in the death of 37-year-old Robert Van Hemert. The male victim was fatally shot during a confrontation with his brother-in-law, Aaron Smith. The events of that day were rooted in ongoing issues Van Hemert was having with his wife.
The situation escalated when Smith accompanied his sister, Van Hemert's wife, to their Hyrum home.
An argument erupted between Van Hemert and his wife concerning a loan she had taken out to pay the rent. Smith intervened to defend his sister, which led to a heated exchange between the two men. Van Hemert then went to another room, retrieved a handgun, and returned to confront Smith.
Faced with an armed Van Hemert, Smith, who was also carrying a concealed weapon, drew his own firearm. He fired multiple times, striking Van Hemert. When law enforcement and paramedics arrived at the residence following a 911 call, they found Van Hemert deceased at the scene. Smith was taken into custody for questioning.
Following an investigation into the shooting, the Cache County Attorney's Office reviewed the evidence. It was determined that Smith had acted in self-defense, reasonably believing that his life was in imminent danger. Consequently, prosecutors announced that no criminal charges would be filed against Aaron Smith in the death of Robert Van Hemert. The case was officially ruled as a justifiable homicide.
