In the evening hours of February 25, 2024, a dispute in Richmond, Virginia, tragically cut short the life of 55-year-old Derrit Banks. Banks, a male resident of the city, was fatally shot in the 300 block of West Clay Street. The incident unfolded around 7:08 p.m., when police were called to the scene for a report of a person shot. Upon arrival, officers found Banks suffering from an apparent gunshot wound.
He was quickly transported to a local hospital, but he ultimately succumbed to his injuries.
The investigation into the shooting led to a swift arrest. Jermorrie Simmons, a 49-year-old Richmond man, was taken into custody and charged with second-degree murder. For a time, it seemed as though the path to justice for Banks's death was clear, with law enforcement stating they were not actively seeking any other suspects in the case.
However, the legal proceedings that followed painted a more complex and ultimately unresolved picture. In November 2024, a judge dismissed all charges against Simmons. The prosecution's case heavily relied on the testimony of Banks's 10-year-old grandson, who was present at the time of the shooting. Accounts of the events leading up to the fatal shot were conflicting. The grandson testified that Simmons was the aggressor, threatening him and a group of teenagers on the porch. Conversely, Simmons claimed the teenagers had been harassing him. It was agreed that a physical altercation broke out between Banks and the teenagers on one side, and Simmons on the other. The grandson stated that Simmons then retrieved a firearm, while Simmons's defense suggested that the shots could have come from another weapon present at the scene, as at least one of the teenagers was also armed. Ultimately, the judge determined there was not enough evidence to prove that Simmons had fired the shot that killed Derrit Banks, leaving his death officially unsolved.
