Thomas Andrew Kindlon, a 23-year-old male from Albemarle, NC, tragically lost his life on September 19, 2016. The incident occurred at approximately 2:50 p.m. at a residence located at 20331-A NC 73 Highway. Upon arrival, deputies discovered Kindlon lying on the ground near the home. Despite resuscitation attempts by EMS, Kindlon was pronounced dead at the scene. Investigators learned that Kindlon was the adopted grandson of the homeowner, Bill Cody, and had been staying with the Cody family for a short period of time.
The suspect, Buford Eugene Misenheimer, a 75-year-old male who rented the basement apartment of Bill Cody's house and had lived there for approximately 16 years, was taken into custody at the scene. During the afternoon of September 19, Cody and Kindlon were outside the home loading equipment into a truck for their next day of work when Misenheimer emerged from inside the residence with a semi-automatic pistol and opened fire on Cody and Kindlon. Kindlon was struck at least once by the gunfire. Cody was eventually successful in disarming Misenheimer.
Sheriff George T. Burris stated that it was still unclear why the shooting happened, but investigators were actively following up on the case. Misenheimer was processed into the detention center and held without bond on charges of first-degree murder and assault with a deadly weapon with intent to kill. Additional charges in this case were anticipated. The investigation into the motive and circumstances surrounding the shooting remained ongoing.
