Upon arrival, Officer Gutierrez observed a broken window leading into the basement of the home. As he approached, he heard a verbal altercation between Shelby and a woman identified as "SC."
Officer Gutierrez announced his presence, and shortly after, a single gunshot was heard, followed by SC screaming that she had been shot. SC, who was bleeding from her neck, attempted to climb out of the basement window but was pulled back inside by Shelby. Officer Gutierrez, seeing the dire situation, fired two rounds through the window, fatally striking Shelby. SC managed to escape the residence with a towel pressed to her neck to stop the bleeding. Another individual, identified as "NG," was also in the home but was unharmed.
The Illinois State Police’s Public Integrity Task Force conducted an investigation into the shooting. They reviewed witness statements, 911 calls, police reports, medical records, and forensic evidence. The investigation concluded that the evidence was insufficient to support criminal charges against Officer Gutierrez. The Cook County State's Attorney's Office reviewed the findings and determined that the shooting was justified, as Officer Gutierrez acted in defense of SC's life.
No arrests were made in connection with Shelby's death, and there were no further suspects or litigations related to the incident. The case was closed after the investigation concluded that Officer Gutierrez's actions were warranted given the circumstances.
