Brockington was found lying next to his Toyota SUV with multiple gunshot wounds. The incident occurred around midnight, and neighbors reported hearing gunshots at that time. Despite his family's assertions that he was a hardworking and law-abiding individual, the police initially had no witnesses or suspects and were unsure of the motive behind the killing. The investigation took a significant turn when surveillance video and witness testimony led to the arrest of Nakia Simmons, a 42-year-old man from Pompano Beach. The video footage showed two men approaching Brockington, with one of them shooting him in the head before fleeing in a white car. A witness later identified Simmons as the shooter, stating that he had driven to the location, tapped Brockington on the shoulder, and shot him in the back of the head. This evidence, along with the matching description of Simmons and his vehicle, led to his arrest.
During a court hearing, Broward Judge Kim Theresa Mollica ordered Simmons to remain in jail without bond, despite objections from his defense attorney, who argued that the evidence was insufficient. The case against Simmons was built on the surveillance footage and the witness's positive identification, which were deemed strong enough to hold him without bond.
