Officer Silva, along with his colleague Officer Gene Simpson, responded to a disturbance call involving a homeless man causing trouble near Fifth and East Santa Clara Streets. Upon arrival, Officer Simpson was the first to engage with the suspect, who quickly became violent. During the struggle, the suspect managed to disarm Officer Simpson, forcing him to seek cover while the suspect began firing at him. Despite Officer Simpson's efforts to track and direct incoming units, he was ultimately shot and killed by the suspect.
Officer Silva, arriving shortly after, confronted the gunman and was shot multiple times in the stomach and leg. Despite undergoing two rounds of emergency surgery that replaced his entire blood supply multiple times, Officer Silva succumbed to his injuries later that evening at San Jose Medical Center. The suspect, identified as Dale Randy Connors, was eventually shot and killed by responding officers after a brief but intense gun battle.
