Fabian Acevedo, a 26-year-old Latino, was tragically shot and killed on October 15, 2017, in East Los Angeles. The incident occurred in the 1300 block of South Atlantic Boulevard, where Acevedo was found lying in an alley parking lot behind businesses and residences. According to the Los Angeles County coroner’s records, sheriff’s deputies were called to the scene at 6:36 p.m. and found Acevedo suffering from gunshot wounds.
He was transported to a nearby hospital but was pronounced dead at 7:13 p.m. Acevedo lived with his mother in Montebello and was described as someone who was simply minding his own business when the shooting occurred.
The investigation into Acevedo’s death revealed that he was likely a victim of mistaken identity. Investigators believe that the shooters mistook Acevedo for a rival gang member, although he had no gang affiliations. Surveillance footage and a tip led to the arrest of two suspects on November 3, 2017. The suspects, Sebastian Santana, a 25-year-old from East Los Angeles, and David Venegas, a 21-year-old from Compton, were charged with murder on November 7, 2017. Venegas also faced additional charges of being a felon in possession of a firearm. Both suspects pleaded not guilty to the charges.
The legal proceedings following the arrests were extensive. Santana and Venegas were tried and convicted for their roles in Acevedo’s murder. They appealed their convictions, but the Court of Appeal upheld the original verdicts. The court rejected Venegas's claims of evidentiary errors and found that the trial court had acted correctly in its sentencing decisions. The evidence presented during the trial was deemed sufficient to support Santana's conviction for aiding and abetting the murder. The court also addressed various procedural and sentencing issues raised by the defendants, ultimately affirming the judgments against them.
