Gustavo Hernandez, a 21-year-old resident of Winchester, California, tragically lost his life on March 4, 2020. Hernandez was fatally shot while sitting in his car on Whitaker Street in Winchester. The incident occurred during a late-night encounter where Hernandez was attempting to sell two pounds of marijuana. His girlfriend and their 2-year-old child were present in the car at the time of the shooting.
The assailant, identified as Ricky Martin Ortiz, approached Hernandez's vehicle under the pretense of inspecting the marijuana. When Hernandez refused to allow Ortiz to take a bag of marijuana to a friend's car, Ortiz filmed the bag, exited the vehicle, and then shot Hernandez multiple times in the head and upper body. Ortiz fled the scene with a bag of marijuana, leaving Hernandez mortally wounded.
The investigation led to the arrest of three suspects: Ricky Martin Ortiz, Omar Arango, and Joe Natividad Orosco III. Ortiz was charged with murder, two counts of assault with a gun, and one count of robbery. He faced a special-circumstances allegation of murder in the commission of a robbery, which made him eligible for the death penalty, although the District Attorney did not pursue this sentence. Ortiz pleaded not guilty to all charges. Arango and Orosco were also charged with murder but later pleaded guilty to one count of robbery. Arango was sentenced to one year in jail and released after receiving credit for time served, while Orosco's sentencing was scheduled for January 8.
The trial for Ortiz began on December 10, 2024, but ended in a mistrial on December 23, 2024, after the jury deadlocked 11-1 in favor of guilt. The District Attorney's office announced plans to retry the case, with the next hearing scheduled for February 18, 2025. The prosecution's case detailed how Ortiz, after shooting Hernandez, was assisted by Arango, who went through Hernandez's pockets, and Orosco, who owned the car used to transport Ortiz and Arango to and from the crime scene.
