In the small community of Moriah, New York, a heated argument outside a local social club tragically escalated, leading to the death of 44-year-old Derek J. 'Boomer' Sprague on April 22, 2018. The male victim was a well-known and beloved figure in the area, remembered for his larger-than-life personality and his dedication to his family and community, including coaching his daughter's basketball team. His sudden and violent death sent shockwaves through the town, not only due to the nature of the incident but also because Sprague was the brother of the sitting Essex County District Attorney, Kristy Sprague.
The events of that fateful evening unfolded at the Eagles Club on Center Road. An altercation that began inside the bar between Sprague and another man, 30-year-old Cody Cutting of Moriah, spilled out into the parking lot. In the ensuing confrontation, Cutting retrieved a. 45-caliber handgun from his vehicle and shot Sprague in the neck. Witnesses heard a 'pop,' and moments later, Sprague was found lying in the parking lot. The argument reportedly stemmed from a dispute over foul language used by Cutting.
Following the shooting, Cody Cutting was swiftly arrested and charged with second-degree murder. Due to the victim's relationship with the Essex County District Attorney, the Warren County District Attorney's Office was appointed as a special prosecutor to handle the case to avoid any conflict of interest. The legal proceedings that followed delved into the specifics of the confrontation, with Cutting claiming he acted in self-defense, stating he was in fear for his life and that the gun had discharged accidentally as Sprague knocked him to the ground. Prosecutors, however, argued that Cutting had the opportunity to leave the scene but instead chose to retrieve his weapon.
Ultimately, a jury acquitted Cody Cutting of the second-degree murder charge. He was, however, convicted of second-degree manslaughter and menacing. In March 2019, Cutting was sentenced to five to 15 years in state prison for his role in the death of Derek Sprague.
