In the quiet expanse of Bayswater Point State Park in Queens, New York, the body of 23-year-old Ian Cruz was discovered on December 16, 2018. The young man had been shot multiple times in the head, a grim end to a life that authorities would soon reveal was cut short by a deadly plot rooted in gang culture.
Investigators quickly pieced together a chilling narrative. Cruz had been lured to the secluded park by a 13-year-old girl with promises of sex and drugs.
This girl was part of a group of individuals associated with the MS-13 street gang, who believed Cruz, a perceived rival, had shown them disrespect. Waiting in the park were other members of the group, armed and ready to carry out a plan to end Cruz's life. As Cruz walked with the girl, Yonathan Sanchez emerged from hiding and shot him four times in the head with a. 22 caliber revolver. After the murder, the group took Cruz's belongings and fled.
Within days, the New York Police Department made several arrests in connection with the murder. Five individuals were taken into custody: Yonathan Sanchez, 22, Carlos Guerra, 18, Elmer Gutierrez, 18, a 15-year-old male, and the 13-year-old girl who had served as the bait. The investigation revealed that this was not an isolated incident; the same group was implicated in the murder of another young man, 17-year-old Harold Sermeno, just days after Cruz's death.
The legal proceedings that followed brought a measure of justice for Ian Cruz and his family. Yonathan Sanchez, the shooter, pleaded guilty to two counts of murder and was sentenced in July 2020 to 34 years to life in prison. Elmer Gutierrez, who was involved in the planning of Cruz's murder and the subsequent killing of Sermeno, pleaded guilty to murder and conspiracy charges. In August 2021, he was sentenced to 20 years to life in prison.
Carlos Guerra, another key participant, pleaded guilty in January 2023 to two counts of first-degree manslaughter and two counts of second-degree conspiracy. He was expected to receive a 28-year prison sentence. One of the then 15-year-old males also pleaded guilty to one count of second-degree murder and was anticipated to be sentenced to 8 1/2 years to life in prison. The cases against the remaining two juvenile defendants, a male and a female, were reported as pending in early 2023.
