Andrew Duncan, a 31-year-old man, was fatally shot in Boulder, Colorado, on February 1, 2016. The incident occurred in the morning in the 4400 block of North Broadway, where Duncan was found with multiple gunshot wounds. He was transported to a nearby hospital where he succumbed to his injuries shortly after. An obituary for Andrew Tyler Duncan states he died on February 5, 2016.
The investigation into the shooting led to the apprehension of two suspects.
Cody Nelson, then 51, was arrested and charged with first-degree murder and prohibited use of a weapon. Miriam Nayeh, 31 at the time, was also arrested and charged with accessory to first-degree murder. Both individuals were booked into the Boulder County Jail.
During legal proceedings, it was revealed that Duncan had visited Nelson's home out of concern for the mother of his unborn child, whom he believed was using heroin at the residence. The shooting occurred as Duncan was leaving the house. Video evidence presented during the trial showed Nelson shooting Duncan, and after he had fallen, standing over him and firing numerous additional shots. In their defense, the suspects alleged that Duncan had been abusive. However, prosecutors asserted that there was no evidence to indicate Duncan posed a threat. In August 2018, Cody Nelson was convicted of first-degree murder and sentenced to life in prison without the possibility of parole.
