On November 24, 2023, 30-year-old Elijah Edward Timmons III was fatally shot in the parking lot of Orchard Bar & Grill in Hendersonville, North Carolina. Responding to reports of gunfire around 2:40 a.m., police found Timmons with a gunshot wound to the head; he was pronounced dead at the scene. A firearm believed to belong to Timmons was recovered nearby.
Investigations revealed that Timmons had been involved in an altercation with another individual prior to the shooting.
After reviewing evidence, including video footage, and consulting with the District Attorney's office, authorities concluded that the shooting was an act of self-defense. Consequently, no charges were filed against the shooter.
Timmons' mother, Patricia King, has publicly disputed the self-defense ruling. She claims that video evidence shown to her contradicts the official findings and continues to seek justice for her son. Despite her efforts, the case remains closed, with law enforcement maintaining their determination of self-defense.
