In the quiet expanse of the George Washington National Forest on January 19, 2023, a confrontation turned deadly, ending the life of 49-year-old Kevin D. Hartless of Amherst County. The male victim was discovered in a remote area off Alhambra Road, having sustained a fatal gunshot wound. The incident, which at first appeared to be a tragic, isolated event, soon unraveled into a story of jealousy and a misguided attempt to document an affair.
Authorities arriving at the scene found and
detained Joseph F. Cunningham, a 43-year-old from Buckingham County. He was initially charged with voluntary manslaughter. The investigation revealed that Cunningham suspected his wife of having an affair with Hartless and had set out to catch them together. Accompanying him that day were his 19-year-old daughter, Summer Cunningham, and her boyfriend, David Chester Christian, a former Longwood University police officer. The trio had reportedly followed Hartless and Cunningham's wife from a store in Nelson County to the national forest.
Once in the secluded woods, a plan to photograph the couple together escalated into a physical altercation between Hartless and Joseph Cunningham. During the struggle, shots were fired, and Hartless was killed. While Joseph Cunningham's defense argued he acted in self-defense after Hartless brandished a weapon, the prosecution presented a narrative of a premeditated confrontation. Subsequently, Joseph Cunningham's charges were upgraded, and both Summer Cunningham and David Christian were also arrested and faced a slate of serious charges, including felony homicide and abduction.
The legal proceedings that followed saw a divergence in the fates of the three accused. In February 2024, a judge dismissed all charges against David Chester Christian, citing a lack of evidence. Later, in August 2024, all charges against Summer Cunningham were also dropped. Her mother stated that her daughter was in the wrong place at the wrong time. Joseph Frank Cunningham, however, was found guilty of second-degree murder and the use of a firearm in the commission of a felony by a jury in May 2024. The jury recommended a sentence of 16 years in prison. His sentencing was scheduled for September 2024.
