In the late hours of September 30, 2023, a dispute ended in the tragic death of 28-year-old Luke James Botica in his home on North 12th Street in Niles, Michigan. Botica, a male, was shot and killed during an argument with another man. Responding to a call about a shooting, police discovered Botica with a gunshot wound to his head. He was quickly transported to Corewell Health Niles Hospital, where he was pronounced dead.
An autopsy later confirmed that the cause of death was the single gunshot wound.
The investigation into the shooting led to the arrest of Jamie Phillip Perry, a 29-year-old man from St. Louis, Missouri. According to a witness at the scene, Michael White, Perry and Botica had been arguing over drugs and money. The witness stated that Perry was going to assist Botica in starting a marijuana grow operation and owed him money. White told police he saw Perry point a gun at Botica, who was unarmed with his hands in the air, and fire one shot. Perry, however, claimed that he only drew his weapon after Botica had pointed a pistol at him and then later a shotgun. A search of the residence uncovered three firearms, including the one belonging to Perry.
Perry was taken into custody and is being held in the Berrien County Jail. He is facing multiple felony charges, including open murder, being a felon in possession of a firearm, and two counts of using a firearm in the commission of a felony. The open murder charge alone carries a potential sentence of life in prison. Perry has a criminal record in Missouri with convictions for burglary and theft.
The legal proceedings against Jamie Phillip Perry have been complex and marked by delays. During a preliminary hearing that spanned several days in late 2023, Perry fired his first attorney and briefly attempted to represent himself before accepting another public defender. In early 2024, a forensic examination was ordered to determine his competency to stand trial. Perry was initially found incompetent but received treatment and was later deemed competent in March. However, he has since been found incompetent to stand trial once again. As a result, his trial has been further postponed, and he has been sent back to a forensic center for additional treatment and therapy, with another competency review scheduled.
