In the winter of 2016, a burst of gunfire in northeast Oklahoma City tragically cut short the life of 26-year-old Chameeka Harris. On the evening of February 3rd, Harris and another individual, 25-year-old Kendre Demond Smith, were both fatally wounded in what authorities would later describe as a double shooting. The incident left a community in mourning and a family grappling with the sudden and violent loss of a young woman known to her loved ones.
The investigation into the deaths of
Harris and Smith eventually led to the arrest of Jamar Mordecai Simms. Prosecutors alleged that the shootings occurred during a drug transaction involving Simms and another individual. In 2018, Simms was convicted of felony murder in connection with the deaths of both Harris and Smith, a charge that applies when a death occurs during the commission of certain felony crimes. He was subsequently sentenced to two consecutive life sentences, seemingly bringing a close to the case.
However, the legal saga was far from over. In a significant turn of events, the Oklahoma Court of Criminal Appeals reversed Simms's double-murder conviction in October 2021 and ordered a new trial. The appellate court's 3-2 decision hinged on the interpretation of the state's felony murder law. The court found that the evidence presented suggested Simms was a buyer, not a distributor, of drugs at the time of the incident. This distinction was crucial, as the court ruled that being purely a buyer was insufficient to uphold a conviction for felony murder based on the underlying crime of drug distribution.
Following the reversal, the Oklahoma County District Attorney's office announced its intention to retry Simms for the killings. The court determined that a new trial could proceed under the alternative theory that the homicides occurred during the commission of a different underlying crime: robbery with a dangerous weapon. This left the final chapter in the quest for justice for Chameeka Harris and Kendre Demond Smith yet to be written, with legal proceedings poised to continue.
