On April 4, 2025, Brian Miller, a 39-year-old male, was fatally shot in Albuquerque, New Mexico. The incident occurred in the afternoon, around 3:05 PM, near the intersection of Indiana Street SE and Central Avenue SE. Miller was an innocent bystander to an altercation that escalated into gunfire.
The events leading to Miller's death began with a fight between two other men.
During this dispute, a man named Deomtray Davis, who was acquainted with one of the individuals involved in the altercation, allegedly opened fire. The intended target was struck in the arm, and the bullet then tragically struck Miller in the head as he stood several feet away. Brian Miller died at the scene.
Responding officers and medical personnel located the man who had been shot in the arm at a nearby bus station, and he was transported to a local hospital. Surveillance footage from the area captured Davis walking away from the scene on foot. Investigators later discovered a firearm that Davis had allegedly discarded in a trash can in a nearby parking lot.
Deomtray Davis, 27, was arrested on April 9, 2025, initially on unrelated charges. Albuquerque Police Department homicide detectives interviewed him and obtained a warrant for his DNA. On April 19, he was re-booked on new charges, including an open count of murder and tampering with evidence in connection with the death of Brian Miller.
