The suspect in Gary's death was his neighbor, Thomas L. Cooley, aged 41. Cooley was arrested and charged with reckless homicide. According to 911 records, Cooley admitted to shooting Gary but also claimed that Gary shot himself. Cooley was later convicted of negligent homicide and sentenced to 180 days in jail, with 80 days suspended. He was also placed on probation for five years and ordered to pay restitution and complete treatment and counseling.
