Larry Pendleton, a 31-year-old male of African American ethnicity, tragically passed away on January 18, 2018, in Toledo, OH. He was a resident of Ohio at the time of his death. Larry Pendleton Jr. was well-known in his community and had a loving family, including his mother Doreta Pendleton, father Larry Pendleton Sr., sisters Tonya Brown and Brittany Pendleton, and his daughter Kylie Pendleton.
The circumstances surrounding Larry Pendleton's death were investigated by Toledo police,
who were called to the scene at 2229 Kent around one Thursday morning for reports of a person shot. Upon arrival, they found Larry Pendleton suffering from at least one gunshot wound. The investigation revealed that Larry Pendleton was involved in a fight with Lavelle Allen, also known as Lavell Allen, in Allen's apartment at Moody Manor. During the altercation, Allen shot and killed Larry Pendleton.
Following the incident, Lavelle Allen was indicted on two counts of murder in violation of R.C. 2903.02, unclassified felonies, each count including a firearm specification. Allen pled not guilty, and a jury trial commenced on August 27, 2018. After the presentation of testimony, evidence, and arguments, the jury found Allen guilty on August 31, 2018. Allen was sentenced to 15 years to life in prison for the murder conviction, with an additional three years of mandatory actual consecutive incarceration for the firearm specification.
The case, State v. Allen, was appealed, but the Supreme Court of Ohio affirmed the trial court's judgment on September 18, 2020. The court found that the jury's verdict was not against the manifest weight of the evidence presented at trial. Allen's request for a jury instruction on the lesser included offense of voluntary manslaughter was denied by the trial court.
Larry Pendleton's death was a tragic event that led to a significant legal battle, ultimately resulting in the conviction and sentencing of Lavelle Allen for murder. The case highlighted issues of self-defense and the legal complexities surrounding violent altercations.
