On the day she went missing, Benita was last seen by her mother at Indiana University Northwest, where both were attending classes. She failed to return home that evening, and her absence was immediately alarming to her family. The following day, when Benita did not report to work, her mother filed a missing person report with the Gary Police Department. Benita's personal life was marred by a tumultuous relationship with her ex-husband, John Lee "Johnny" Spears Jr. The couple had married after high school and had two sons together. However, their marriage was fraught with domestic violence. In 1988, Johnny was charged with two felonies after he beat Benita, abducted her at gunpoint, and took her out of state. He pleaded guilty to criminal confinement and was sentenced to two years in prison. Benita filed for divorce that same year, seeking to distance herself from the abuse.
Johnny Spears was released from Lake County Jail the night before Benita disappeared. Shortly after her disappearance, he was seen driving her 1981 Oldsmobile Omega, which had been parked at her home when she was reported missing. The vehicle was later found on November 23, 1989, abandoned in a parking lot at the South Shore Line in East Chicago, Illinois.
