In the late summer of 2022, a dispute over money between a father and son in Lewisburg, Kentucky, escalated to a fatal conclusion, leaving one man dead and the other facing a murder charge that would later be dismissed. Richard Evans, a 37-year-old male, was shot and killed by his father, Darrell Evans, then 61, on Thursday, August 4, 2022, at his father's home. The deadly confrontation was the culmination of an argument that began outside the residence.
The argument reportedly centered on money that Richard owed his father. According to statements made by Darrell Evans to law enforcement, the verbal dispute intensified, with Richard clenching his fists. When his father questioned if the gesture was for him, Richard allegedly replied, 'They can be.' Following this exchange, Darrell went inside his home, and Richard followed him. Inside, Richard warned his father not to reach for the pistol he kept on his loveseat. It was at this point that Darrell Evans grabbed the firearm and shot his son once in the head or face area. Believing his son to be deceased, Darrell went outside and informed his brother before calling 911. When sheriff's deputies arrived, they found Richard Evans inside the home with a single gunshot wound.
Following the shooting, Darrell Evans was arrested and charged with first-degree murder. In September 2022, a Logan County grand jury indicted him on the charge of murder. For over a year, Darrell Evans remained jailed as the case proceeded through the legal system.
However, in December 2023, a Logan Circuit Court judge dismissed the murder indictment against Darrell Evans. The judge ruled that Darrell had acted justifiably under Kentucky's 'stand your ground' law, which permits the use of deadly force when an individual believes it is necessary to protect themselves from imminent death or serious physical injury. The court determined that Richard Evans's actions of aggressively following his father into the home and making threats constituted forcible entry, legally justifying the use of deadly force. The ruling also noted Darrell Evans's poor health and the age difference between the two men. An autopsy had found drugs in Richard Evans's system, and police discovered six small bags of methamphetamine in his possession. Following the dismissal of the charges, Darrell Evans was released from custody.
