On June 4, 2023, Kevin Eugene Jones, 38, of Dayton, Ohio, died during a shooting incident at an apartment on Superior Avenue. Jones, along with Lawrence Davis, 22, and Riyadh Pate, 19, arrived at the apartment, where an exchange of gunfire ensued between them and the occupants. Jones was pronounced dead at the scene, and four others sustained injuries but were reported in stable condition.
Following the incident, Davis and Pate were indicted on multiple charges, including murder, felonious assault, and aggravated burglary. Under Ohio law, individuals can be held responsible for any death occurring during the commission of an aggravated burglary, even that of an accomplice. Both men pleaded not guilty, and their bonds were set at $1 million each.
In September 2024, a judge acquitted Davis and Pate of two murder charges and two felonious assault charges, citing insufficient evidence to sustain a conviction. However, they still face additional charges, with a trial scheduled to begin in January. The case remains under legal proceedings as the community seeks justice for the events that transpired.
