In the early morning hours of July 28, 2024, the life of 44-year-old Nathan Ogden was cut short in a fatal home invasion in Capitan, New Mexico. At approximately 4:30 a.m., a vehicle carrying four individuals arrived at Ogden's residence at 104 Aspen, Trailer 18. One of the individuals, Benisha Shanta, 33, of Capitan, approached the door and knocked for several minutes.
When the door was opened, three men, Daniel Hernandez, 29, Gabriel Thyberg, 41, and Samuel Rey Duran, 30, all from Roswell, forced their way into the home.
The male intruders were disguised with masks, bandanas, and shirts bearing "RPD" on the front and "POLICE" on the back, with one wearing a ballistic vest. Announcing themselves as police, the armed assailants shot and killed Nathan Ogden. His girlfriend, who was also present in the residence, was not physically harmed. The intruders proceeded to steal an unspecified amount of money and narcotics before escaping the scene.
A multi-state investigation and manhunt ensued, leading to the apprehension of all four suspects. On August 5, Benisha Shanta was located and arrested in El Paso, Texas, with the assistance of the United States Marshals Service. The following day, New Mexico State Police agents arrested Daniel Hernandez in Roswell. Gabriel Thyberg was apprehended in Albuquerque on August 9 by State Police and the U.S. Marshals Service. The final suspect, Samuel Rey Duran, was arrested in Albuquerque on August 30, also by State Police and the U.S. Marshals Service. His girlfriend, Angela Montoya, 27, of Roswell, was also arrested and charged with Felon in Possession of a Firearm.
All four main suspects face a range of serious charges, including first-degree murder and armed robbery. Shanta is also charged with conspiracy to commit armed robbery. Hernandez, Thyberg, and Duran face additional charges of attempt to commit a felony and impersonating a peace officer, with Duran also facing a charge of felon in possession of a firearm.
