On April 26, 2024, Julie M. VonSchlegell Elguezabal, a 49-year-old resident of Villa Park, Illinois, was tragically killed by her husband, Winston Elguezabal, in a murder-suicide incident.
Winston Elguezabal had been arrested on April 14, 2024, and charged with misdemeanor domestic battery against his estranged wife, Julie. According to court records, he was accused of pulling Julie's hair and punching her several times in the face, neck, and back.
Despite his history of violence, Winston was released from jail just two days later, on April 16, 2024, under the terms of the SAFE-T Act, which eliminated cash bail and required pretrial release conditions. He was placed on a GPS monitor and ordered to stay at least 1,000 feet away from Julie. He was also required to surrender all firearms and his Firearm Owner’s Identification (FOID) card, which he did on April 17.
However, the measures in place did not prevent the tragic outcome. On the night of April 26, 2024, Winston's GPS monitor alerted the Villa Park Police to his presence near Julie's home. Responding officers arrived around midnight and found Winston and Julie deceased in a bedroom, with a gun next to Winston. The couple's two teenage children were safely evacuated from the scene.
The incident has raised significant questions about the handling of domestic violence cases and the effectiveness of the current pretrial release system. The DuPage County State's Attorney, Robert Berlin, has vowed to address the systemic issues that led to this outcome, including enhancing protections for victims of domestic battery and improving the timeliness and quality of information provided to prosecutors.
An investigation by the Illinois State Police is ongoing to determine how Winston Elguezabal obtained a firearm despite his history and the surrender of his FOID card. Advocates, such as Amanda Pyron from The Network Advocating Against Domestic Violence, are emphasizing the need for thorough examinations of domestic battery cases and stronger engagement with survivors to understand the risks involved.
