City Marshal Marcus Tillman Cage, aged 34, was accidentally shot in the top of his head and mortally wounded by W.J. Schubert on October 14, 1903, in Mineola, Texas. Marshal Cage was attempting to assist W.D. Kitchens, a local businessman who had just been shot by Schubert, when he was struck by a bullet. The incident occurred during an argument and gunfight on Johnson Street in Mineola, which started over allegations that Kitchens had violated liquor laws.
After Marshal Cage was shot, Kitchens picked up a pistol and shot and instantly killed W.J. Schubert. N.M. Harpole, a bystander, was also wounded by the gunfire. Marshal Cage never fired his weapon during the incident. He succumbed to his injuries three days later, on October 17, 1903. Cage was survived by his wife Laura, and they are both buried in the Mineola City Cemetery.
The case did not lead to any arrests or litigations, as the shooting was deemed accidental. Marshal Cage's death was a tragic result of a chaotic and violent confrontation, and his sacrifice is honored by the Mineola Police Department and the community.
