Game Warden Justin Phillip Hurst, aged 34, was shot and killed on March 16, 2007, in Wharton County, Texas. The incident occurred following a high-speed pursuit on U.S. Route 90 ALT. The pursuit began when another game warden suspected a man of illegally hunting from the roadside. Warden Hurst was called in as backup, and together with officers from other agencies, they pursued the suspect through two counties. The suspect exchanged gunfire with the officers at the intersection of U.S.
Highway 90 ALT and County Road 252 in Wharton County. During the shootout, Warden Hurst suffered several gunshot wounds and was flown to a local hospital, where he succumbed to his injuries early the next morning, on his 34th birthday.
The suspect, identified as James Garrett Freeman, was also shot and wounded during the exchange and was taken into custody. He was later convicted of capital murder and sentenced to death. Freeman's execution took place on January 27, 2016. The case drew significant attention due to Freeman's lack of a violent criminal history; he was on probation for a DWI at the time of the shooting but had never faced violent charges before.
Warden Hurst, who had graduated from the academy in August 2002, is remembered for his dedication and service. He is survived by his wife, a 4-month-old son, parents, and brother. The loss of Warden Hurst was deeply felt by his family, colleagues, and the community.
