Antoine Reese, a 24-year-old male of African American ethnicity, tragically lost his life on September 17, 2018, in Cleveland, Ohio. Reese was fatally shot in the back by Dujuan Wiley, a 24-year-old man, during an altercation at Wiley's residence. The incident occurred when Reese and two other men entered Wiley's bedroom, leading to a confrontation in which Wiley claimed he feared for his life.
Wiley managed to wrestle a gun away from one of the attackers and shot Reese as they attempted to flee the scene.
Following the shooting, Wiley fled the scene by jumping out of a second-floor window and went into hiding. Approximately 15 months later, Cleveland police located Wiley and his girlfriend, discovering illegal drugs, drug paraphernalia, and the handgun used to kill Reese. Wiley was subsequently indicted on multiple charges, including felony murder, felonious assault, and voluntary manslaughter.
The case went to trial, and Wiley was convicted of felony murder and voluntary manslaughter. The jury found that Wiley shot Reese while under the influence of sudden passion or a sudden fit of rage, which was brought on by serious provocation by Reese. Wiley appealed his conviction, arguing that it wasn't legally possible to be found guilty of felony murder if the jury found he acted with sudden passion or rage. The Eighth District Court of Appeals ordered a new trial to reconsider the charges.
The Supreme Court of Ohio is set to hear Wiley's appeal, which will determine whether the jury's finding of sudden passion or rage must carry over to the retrial, potentially barring him from facing the more serious felony murder charge. The Cuyahoga County Prosecutor’s Office contends that the second jury isn't bound by the first jury's decision and that Wiley can still face all three charges.
