Fernando Rojo Jr., a 26-year-old Latino, was tragically killed on March 19, 2016, in a drive-by shooting in the Vermont Square neighborhood of Los Angeles. According to authorities and the L.A. County coroner’s records, the incident occurred shortly after midnight when Rojo and a group of friends were hanging out in the 1500 block of West 53rd Street. A white mid-sized SUV with several males inside approached them, and one of the occupants asked, “Where you from?” before opening fire.
Rojo and a 23-year-old Latino were struck by the gunfire. Both were taken to the hospital, where Rojo was pronounced dead, while the 23-year-old survived. The assailants, believed to be affiliated with gangs, fled the scene in the SUV.
The investigation into Rojo’s death led to the arrest of Rudy Dominguez, an admitted member of the 18th Street gang, who was charged with Rojo’s murder, the attempted murder of Rojo’s five friends, and six counts of discharging a firearm from a vehicle. Dominguez, the suspected getaway driver, faced life without parole. However, the case became controversial when Rojo’s family accused the Los Angeles County District Attorney’s office of making a sweetheart plea deal with Dominguez for a shorter seven-year sentence. The family expressed their frustration, feeling that justice was not being served adequately.
Despite the family’s claims, a spokesperson for District Attorney George Gascon stated that no plea deal was ever offered to Dominguez. The district attorney’s office attempted to get special circumstance allegations dismissed, but these efforts were denied on two different occasions. The case highlighted the complexities and challenges within the justice system, particularly regarding new justice reforms that no longer allow gang enhancement charges, which would have resulted in longer sentences for gang-affiliated criminals.
