I’ve been thinking about the role of ineffective assistance of counsel claims in cases like Tonia Herring’s. It’s so upsetting to see this kind of argument being brought up when the evidence is strong enough to support a felony murder conviction. Appeals based on claims of inadequate legal representation seem to kind of gloss over the real tragedy here — the loss of Tonia’s life and the impact on her family and friends. While it's crucial for defendants to have competent legal assistance, we can't lose sight of the fact that a woman died needlessly. Does anyone else think that sometimes these appellate arguments shift the focus away from the victims? My thoughts are with Tonia’s loved ones who have had to endure this painful legal process on top of their loss.
