In the early morning hours of a summer Friday in Rock Hill, South Carolina, a dispute over the custody of a five-month-old child escalated into a tragedy that claimed the life of a young father. Charles Curtis Gaither Jr., a 26-year-old Black man, was shot and killed on July 28, 2023, during the heated confrontation. Another man, Gaither's brother, was also wounded in the shooting but survived his injuries.
When emergency services arrived at the scene, they found Gaither already deceased.
The incident stemmed from a disagreement concerning Gaither's infant child. The man who would be charged in connection with the shooting was the brother of the child's mother. Rather than involving law enforcement in the custody dispute, he brought a loaded firearm to the confrontation. The argument turned violent, and both Gaither and his brother were shot in the back as they were trying to get away. It was noted that neither of the victims was armed or had fired a weapon. The presence of other people nearby, including small children, added to the gravity of the situation.
Following an investigation into the shooting, Maurice Lamont Burris Jr., 26, was arrested and initially charged with murder. In court, the judge questioned why the police were not called to mediate the custody issue before it led to violence. Ultimately, Burris pleaded guilty to the lesser charge of voluntary manslaughter in the death of Charles Gaither Jr. He also entered an Alford plea for the attempted murder of Gaither's brother, meaning he did not admit guilt but acknowledged that a jury would likely convict him. In June 2024, a judge sentenced Burris to 15 years in prison for his role in the deadly shooting.
