On February 10, 1996, Germano DiLorenzo, a 46-year-old man from Santa Cruz County, California, embarked on a boating trip with four friends aboard a 20-foot blue and white Sunbird boat. Their journey took them near Greyhound Rock in the Pacific Ocean, approximately four miles south of Año Nuevo Island. What began as a recreational outing quickly turned disastrous when a series of large waves capsized their vessel, throwing all five men into the frigid waters.
The sudden overturning of the boat left the men fighting for their lives in the open sea. While surfers in the vicinity managed to assist in rescuing four of the passengers, DiLorenzo was not among them. Notably, he was not wearing a life jacket and was unable to swim, factors that significantly diminished his chances of survival. Witnesses reported seeing him slip beneath the water's surface, never to reemerge.
In the aftermath of the incident, rescue teams conducted extensive searches in the area, hoping to locate DiLorenzo. Despite their efforts, no trace of him was found. Given the circumstances—his inability to swim, lack of a life jacket, and the treacherous ocean conditions—authorities concluded that he had likely drowned. His body was never recovered, leaving his family and friends without closure.
In 1997, a year after the tragic event, DiLorenzo's wife initiated a wrongful death lawsuit against the boat's captain. The lawsuit alleged negligence on the captain's part for failing to ensure that DiLorenzo wore a life jacket, a precaution that might have saved his life.
